Please take a moment to review my standard terms of service for design projects. If you notice any issues that may be of concern, please inform me before the project commences. We can then discuss any necessary adjustments for your specific project.
Prior to starting work on your project, I may request a 50% deposit which must be paid within 30 days of the invoice being generated and delivered via email. By submitting the deposit, you agree to these Terms of Service and enter a contract with Creative Nomad.
The remaining cost of the project and any associated services must be paid in full before the release of any logo files or final exports. I have the right to withhold delivery until payment has been received.
If you have been unresponsive or uncontactable for more than 30 days, I reserve the right to invoice prior to the previously agreed-upon time.
Payment plans may be accepted at my discretion and must be agreed upon in writing by both parties.
All payments must be made within 30 days of issue. If an account remains unpaid for more than 30 days, I reserve the right to charge fees incurred during collection and recovery processes.
By agreeing to these Terms of Service, you acknowledge that you are not granted any rights or permission to use, modify, alter, replicate, or borrow any of the ideas, concepts, or sketches presented by Creative Nomad. The original preparation materials, sketches, visuals, and unused ideas will remain the sole property of Creative Nomad.
Creative Nomad is free to utilize these unused and previous ideas for future conceptual and client work. In the event that an unused idea or design retains a similar appearance and style to the final logo, Creative Nomad will repurpose and style it to ensure that the end design is distinct enough to avoid conflict.
Unless otherwise arranged, Creative Nomad reserves the right to feature the final logo and associated designs in their portfolio and across various online and printed media, including books and magazines. The associated designs and artwork can include commercial print design, business cards, stationery, signage, desktop icons, mobile phone applications, and other portable device icons and imagery.
Any supporting artwork and designs required by this project can be used at Creative Nomad’s discretion for personal and professional reasons.
While you are free to modify and adapt the final logo design, you do so at your own risk.
Creative Nomad retains ownership of all preparation materials, sketches, visuals, and electronic files utilized in creating the project. Ownership of the final artwork and digital files will be transferred to you only upon receipt of final payment for the project.
In the event that final payment is not received in accordance with the agreed-upon terms, Creative Nomad will retain ownership of all designs and concepts until payment is received. In such instances, Creative Nomad reserves the right to reuse or modify any ideas for other clients, or to utilize them as examples in their portfolio.
If you attempt to use, modify, replicate, or steal any ideas without making the final agreed-upon payment, Creative Nomad will take legal action.
Creative Nomad may showcase any artwork, ideas, or sketches produced for this project in their portfolio as examples of their work, with the exception of instances where specific confidentiality or non-disclosure requirements have been agreed upon beforehand.
Final payment transfers ownership of the agreed-upon logo design to you, while any previous ideas or concepts will remain the property of Creative Nomad unless otherwise agreed upon.
Cancellation during the project
In the event that the project is canceled before completion despite the submission of ideas and proposals, a refund of the previous payment is not feasible. Nevertheless, a portion of the funds may be returned depending on the work done and the overall budget.
Should I become ill or unable to finish the project due to unforeseen circumstances, a portion of the total budget will be reimbursed. In most circumstances, the entire amount will be refunded. If any work completed thus far is adaptable for another designer to continue with, a percentage based on the work completed will be refunded. Alternatively, any other reasonable proposals will be taken into consideration.
I maintain the right to halt any project in case of overbearing micromanagement, persistent distrust, failure to progress beyond a reasonable number of distinct logo ideas, or reluctance to pay the final fee. Adequate warning will be provided with an opportunity to rectify the issue before resorting to suspension or termination. Any suspension or termination will not lead to refunds, and all work produced will belong entirely to Creative Nomad.
If I am unable to fulfill any obligation under these Terms of Service due to circumstances beyond my control such as acts of God, government actions, terrorism, riots, war, accidents, or any issues with materials or transportation, it will not be considered a violation of these Terms of Service. However, I will notify you of the reason for my inability to perform and will resume as soon as possible once the issue has been resolved.
By utilizing any of my services, you acknowledge and agree that Creative Nomad is not accountable for any loss or damage resulting from the use of my services, including any errors, omissions, or modifications made to documents, designs, information, or any goods or services I offer. This includes any third-party content, links, comments, or advertisements that you may use or rely on. Your use of any information or materials that I produce, modify, or design is done entirely at your own risk, and I shall not be held liable.
You understand that the information and materials I provide may contain inaccuracies or errors, and therefore, Creative Nomad shall not be liable for any such inaccuracies or errors to the fullest extent permitted by law.
I confirm that all designs I present to you will be original and will not infringe on any other work to the best of my knowledge. I will perform limited checks to ensure that my work is not unintentionally infringing on another’s design, including limited checks against the WIPO database and reverse image checks across search engines. However, I do not assume legal responsibility for any loss or damage resulting from legal issues regarding the originality or authenticity of my work. You are responsible for performing your own checks and due diligence regarding plagiarism and originality. If you have any concerns, please discuss them with me before starting work.
As the process of initiating a Trademark, Copyright, or legal name search is typically lengthy and expensive, I regret that I cannot offer any practical assistance with this matter. If you wish to register the design as a trademark, it is recommended that you seek legal counsel.
Prior to commencing work, it is your responsibility to ensure that your company/product/name is legally available. Any legal complications arising after the completion of the project will not result in refunds and I cannot be held liable for any issues that may arise.
To avoid costly and time-consuming project delays, it is crucial that you confirm the legal safety of the name you wish to use before beginning the logo design process. In the event that a name change is required during the project and significant logo exploration has already been completed, I will need to adjust the total cost of the project to accommodate the additional work required.
Please ensure that the name you choose has been thoroughly checked to ensure it is not already in use by another company or infringing on any registered trademarks or business names.
